‘Sin Tax’: California Targets Guns with New Tax

Two years ago, California enacted an 11% excise tax on firearms and ammunition sales to fund programs addressing gun violence. Signed by Gov. Gavin Newsom, the law took effect in 2024. The initiative aims to generate $160 million annually for measures like gun violence prevention and school safety programs.

The California tax followed a federal tax of 10–11% paid by gun dealers, which funds wildlife conservation efforts. Assembly member Jesse Gabriel claimed the tax targets manufacturers profiting amid increasing gun violence.

Gabriel said, “It’s shameful that gun manufacturers are reaping record profits at the same time that gun violence has become the leading cause of death for kids in the United States. This law will generate $160 million annually to fund critical violence prevention and school safety programs that will save lives and protect communities across the State of California.”

Sen. Jim Risch (R-ID) and Rep. Darrell Issa (R-CA) have since introduced federal legislation to block such state taxes, calling them constitutional violations. Introduced in 2025, the Freedom from Unfair Gun Taxes Act aims to prevent states from imposing firearm and ammunition excise taxes.

Risch said, “Blue states that implement an excessive excise tax to fund gun control initiatives are exploiting the Second Amendment.”

Republicans said the taxes are an unfair burden on lawful gun owners. Similar initiatives are currently pending in Maryland, New York, and Massachusetts. Colorado has set plans to adopt an excise tax by mid-2025.

Risch said, “The Freedom from Unfair Gun Taxes Act ensures states do not place a significant financial burden on law-abiding gun owners to advance their anti-Second Amendment agenda.”

Issa said, “The latest attack is California’s imposition of a ‘sin tax’ on firearms and ammunition.”

California’s measure allocates funds to programs like the California Violence Intervention and Prevention Program, gun relinquishment initiatives, and local law enforcement. Critics, primarily Republicans, have described these measures as extreme, arguing they exploit gun ownership to fund specific agendas.
